Node4

General

The Services allow you to backup a windows or MAC desktop or laptop utilising Node4’s Cloud storage platform, N4CloudStore. You agree to use the Services only for lawful purposes and will adhere to all laws, rules and regulations applicable to your use of the Services, including all provisions set forth in these Terms. The Customer shall not use the Services:

  • to store illegal content, content designed to offend or cause needless anxiety to others, any material which is abusive, indecent, defamatory, obscene, threatening, menacing or likely to cause harassment or which is in breach of any copyright, confidence, privacy or any other rights or scanning software;
  • to distribute illegal, copyright infringing, indecent or offensive material;
  • to send or procure the sending of any unsolicited e-mail; or
  • in an unlawful manner or for any illegal purpose.

Whether or not express reference is made to Customer Personnel in the relevant provision, the Customer will procure that all Customer Personnel comply with all the duties, obligations and restrictions imposed on the Customer by the Agreement, to the extent such duties, obligations and restrictions are applicable to the Customer Personnel. Any act or omission of any Customer Personnel which, if it had been committed or omitted by the Customer, would have been a breach of the Agreement by the Customer will be deemed to be a breach of the Agreement by the Customer who will be liable to Node4 accordingly.

Protection and Maintenance of Your Account

You should treat your password and other account information as confidential and not disclose it to any other person that you do not authorize to use your account. You are responsible for ALL activities that occur using your account, including activities by your employees, family members and other third parties. We are not responsible for unauthorized access to your account unless such access is caused by our breach of these Terms. Therefore, you should take appropriate safeguard measures in creating and protecting your account, password and security information. You should use particular caution when accessing your account from a public or shared computer so that your information is not captured or stored on such computer and so that others are not able to view or record your password or other personal information. You should contact us immediately if you believe your account has been compromised or if you become aware of any unauthorised use of your account. No Charge 30-Day Trial Node4 provides a 30-day Services trial, beginning when the account is opened, for the evaluation of the Service. The 30-day Services trial includes the following resources at no charge:

  • Download and activation of PC or Laptop backup agent
  • 10 GB Cloud storage on n4CloudStore

If additional resources are required beyond what the above 30-day trial Node4 provides, you will need to upgrade your account and provide billing information. This can be achieved by contacting your Node4 account manager.

No-Charge 30-day Trial Conclusion:

Services will be suspended on the 31st day following the conclusion of your 30-day Trial period. To continue Services you must contact your account manager to agree a services contract and provide billing information. If no billing information is received prior to the end of a five day period following the 30th day, the account and Services will be terminated. PLEASE REMEMBER that once a set of Services is deleted, it cannot be restored and all information and content is forever gone. The Acceptable Use Policy (AUP) includes basic rules and guidelines governing your use of the Services and the type and nature of User Content (as defined in the Terms) that may be posted by you or uploaded to our network and servers. Each and every customer that uses Node4’s network and infrastructure is responsible for following the rules set forth in this AUP. The full AUP can be viewed on the Node4.co.uk website. We understand that in using the Services, you will run, transfer, process, use, store or interface with software, data, text, audio, video, images or other content (“User Content”) that you upload to our network. You are solely responsible for the ownership, licensing, development, content, operation, maintenance, and use of such User Content. If any of the User Content includes software that you license from a third party, you are solely responsible for adhering to the applicable license for such content. Without limiting the foregoing, you are solely responsible for (a) the technical operation of your User Content; (b) compliance of your User Content with these Terms and applicable laws and regulations; (c) any claims relating to your User Content; and (d) dealing with any notices you receive with respect to your User Content, including notices respecting potential copyright and intellectual property issues. You represent and warrant to us that you are the owner or valid licensor of any User Content. This service is delivered as an unmanaged trial.
